Discrimination suit can proceed against OH college – The-News

CINCINNATI (AP) -- A federal appeals court has ruled that a woman can proceed with her lawsuit alleging Ohio State University discriminated against her because she has Crohn's disease.

The 6th U.S. Circuit Court of Appeals on Monday ruled the lower court was wrong in dismissing the suit. A magistrate found that Caitlin Sjostrand lacked evidence that would allow a jury to find the school rejected her application to a psychology doctoral program because of her ailment. The appeals court sent the case back for trial.

Sjostrand alleges her two interviews with professors in the school's doctoral program in psychology focused mostly on her ailment. She was the only one of seven applicants rejected.

She charges OSU violated her rights under the federal American with Disabilities Act.

Attorneys didn't immediately return calls Monday.
